Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling from and struck-by. (a)On or about 13 September 2002, at the Lee Builders, Inc., construction site, located at 262 Old Highway 431, Owens Cross Rds, AL., use of a safety platform firmly secured to the lifting carriage and/or forks was not used, a employee was standing on the forks of a lull working, the employee was exposed to a fall hazard of 6-8 feet. Among other methods, one feasible and acceptable method to correct this hazard is to use a personnel platform designed for the purpose of lifting personnel.
