Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: being thrown from and crushed by fork lifts a.On or about November 14, 2002, in the Machine Shop - An Employee was driving a Fork Lift without a seat belt installed and no requirements for its use. Among other methods, one feasible and acceptable method would have been to install and ensure the required use of a seat belt.
