Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevation of 10ft. while working from the bucket of a Bobcat Skid-Steer Loader: Among other methods, one feasible and acceptable abatement methods to correct this hazard is to: (1) Operate and use the machinery in accordance with the manufacturer's recommendation and adhere to all warning labels which prohibits the use of the loader bucket as a man lifting device (Operator Safety Warnings/Melroe Ingersoll-Rand Operation and Maintenance Manual); develop and implement a comprehensive safety training program to be successfully completed prior to permitting employees to operate Bobcat Loaders; and prohibit the practice of allowing employees in the bucket of a Bobcat Loader. (a)At 5406 Livingston Oaks Circle - Southside Building #6 - On or about 03/11/03 - An employee was observed working from the bucket of Bobcat Loader, MN 763, Bucket #412078. The employee was exposed to a 10ft. fall hazard.
