Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Fall hazards (a)On or about 04-16-2003, at the All-South Subcontractors, Inc. construction site located at 1811 Parkway Circle, Cullman, AL., the gradall G6-42A rough terrain fork lift being used with a personnel platform did not have an operator at the controls while employees were working from the personnel platform. Among other methods, one feasible and acceptable method to correct this hazard would be to have an operator at the controls at all times when employees are working from the personnel platform.
