Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a scaffold collapse.
a) 1000 Kapkowski Ave. Elizabeth NJ.  CSI Builders Inc. employees were
exposed to
the recognized hazard of scaffold collapse and subsequent falls in that
the scaffold was
not erected or dismantled according to the manufacturer's requirements.
This condition
resulted in a collapse of the scaffold and serious injury of three workers
on or about
12/3/02.
One feasible and acceptable method to abate this condition is to is to
follow the manufacturer's
printed instructions and training instructions as follows:
1. Install ties to the building at designated intervals and specifically
on the third
mast section 10' to 15' above grade.
2. Add and remove platform extensions only while the platform is at the
five-foot
level and the second to last tie is installed.
3. Remove workers from platform prior to removing the second to last tie
and
prior to adding or removing platform extensions.
4. Remove the second to last tie only when the mast is supported by a
crane or
forklift.
