Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to falling and crushing hazard:
a- Owens-Brockway/Rail Dock Area:  Procedures and/or other approved means
were not provided to
prevent employee(s) from falling off of railcar, falling into railcar
and/or being hit by railcar.
Observed 4/30/30.
One feasible and acceptable method to correct this condition is to create
a safety procedure for the
employees involved in performing this operation.   The safety procedures
to include but not limited to:
1- Written procedures for ascending and descending the top of the
railcar(s) to access the
hatchway.
2- Written procedures for crossing the track to the other side of the
railcar to perform
connection operations.
3- Establish procedures to ensure communication between Conrail and site
employees to
determine  that all employees are clear of the track area.
4- Provide means, e.g., signals, flags or verbal warnings to site
employees that the railcar(s) is
moving.
5- Ensure that all railcar wheels are chocked, blocked or secured when
site employees are
working around them.
6- Perform an assessment for tools required to be used to perform the
hatchway opening
operation, e.g., wire cutters, the appropriate size to be used, etc.
7- Perform a safety assessment for the use of the fixed ladder and the top
of railcar and
provide adequate fall protection, e.g., lanyard/belt, harness and/or other
approved means.
8- Perform a safety assessment for the hatchway opening to prevent
employees from falling
into the railcar during product observation operations.
9- Provide training to all affected employees and all supervising
employees relative to these
procedures.
10- Provide means to enforce these procedures.
11- Enforce that site supervisors have final responsibility of the
location of all site railcar
operation employees during setup and dispensing.
