North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a caught in hazard: Reference ANSI/ASME B20.1 - 1990 sec. 5.11.2(1) a)facility - on or about 8/10/01 employees and supervisors were performing maintenance on a 624 Festoon machine, without audible warning devices that could be clearly heard at all points along the conveyor during the start up operations.
