North Carolina General Statute Section 95-129(1) of the Occupational Safety and Health Act of North Carolina. The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing by falling portion of trailer: a)628 Rocky Fork Church Rd.,-on or about 10/19/01 at 06:00, the goose neck portion of a blocked or supported Talbert 40 ton low boy trailer, model T3DW40HRG-1-T1 disconnected from the trailer and fell, striking two employees.
