Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fire/explosion: a) Boiler Room: Employer allowed an unqualified employee to perform welding operations on Federal HRT wetback fire-tube boiler, built in 1963, (Boiler No. 2). "Among other methods, one feasible and acceptable abatement method to correct this hazard is have qualified employees perform welding operations in accordance with State of New Jersey Administrative Code N.J.A.C. 5:11-4.8, Welded Repairs and Alterations to Boilers and ASME Boiler and Pressure Vessel Code, Section IX - Welding and Brazing Qualifications." Violation occurred on or about 12/17/2001 and/or 12/18/2001
