Section 5(a)(1) of the Occupational safety and Health act of 1970; The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or are likely to cause death or serious physical physical
harm to employees in
that fork lift operators were exposed to caught-in between hazards while
operating forklift
trucks without wearing seat belts:
(a)P & O Terminals Shed 11 - Paragraph 5.3.19 of American National
Standards
Institute (ANSI) B 56.1c 1991 (Safety Standards for low Lift and High Lift
Trucks), Forklift Operator was operating a 5K Hyster fork truck, Serial
Number D004D08245W, without the use of his seatbelt/restraint devices to
reduce entrapment of the operator's head and/or torso between the forklift
and
the ground in the event of a tipover, on or about 11/27/01.
(b)P & O Saudi Vessel - Paragraph 5.3.19 of American National Standards
Institute (ANSI) B 56.ic 1991 (Safety Standard for Low Lift and High Lift
Trucks), Forklift Operator was operating a large 25K Taylor fork truck, No.
55002, without the use of his seatbelt/restraint device to reduce
entrapment of
operator's head an/or torso between the fork lift and the ground in the
event of
a tipover, on or about 11/27/01.
