29 CFR 1960.8(a) The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the entrapment of the operator's head and/or torso between the fork lift truck and the ground in the event of a tipover: (a) Outside of Building 90, FL 27 - A Painter Leader was operating a 5000 lb. capacity Hyster forklift on a concrete surface without the use of a seat belt, that was supplied on the vehicle, on or about 07/29/02. (b) Outside of Building 90, FL 10 - A Painter was operating a 6000 pound capacity forklift without the use of a seatbelt, that was supplied on the vehicle, on or about 07/29/02. Among other methods, one feasible and acceptable abatement method to correct the hazard is to establish and enforce the requirement for operators of powered industrial trucks which are equipped with operator restraint devices or seat belts to use the devices as stipulated in the current versions of ANSI B56.1, consensus standard for powered industrial trucks; ASME/ANSI B56.1a-1989 Addenda to ASME/ANSI B56.1-1988, and ASME B56.1-1993 Standard for Low Lift and High Lift Trucks. In addition, seat bealts have been supplied by many manufacturers of countered balanced, center control, high lift trucks which have a sit- down nonelevating operator position. Also, some manufacturers have instituted retrofit programs for the installation of operator restraint systems to older powered industrial trucks. Abatement Documentation Required
