General-duty citation text
Serious Citation 1, item 1; in reference to 1910.178(a)(4). Title 40.1-51.1(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing of likely to cause death or serious physical harm to employee who were exposed to a fall hazard when being raised to another level while standing on a wood pallet attached to a material lift vehicle (industrial power truck). The pallet was not secured to the forks of the lift vehicle, there were no guard rails attached to the pallet and no other fall protection was provided for the employee standing on the pallet. Modifications and additions which affect the safe operation of this vehicle shall not be performed by the customer or user without manufactures prior written approval. There was no written approval from the supplier of the lift vehicle to have employees riding on the forks of the vehicle. One feasible and acceptable abatement method among others to correct this hazard is to prohibit employees riding on the forks of the lift vehicle. Also, the company could install a working platform with the appropriate fall protection and securely attached to the forks of the lift vehicle.
