Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 10/16/01,at the Brownwood Manor Nursing Home construction site,anemployee of Dale Crampton attempted to clean the fuel tank of a Garlock Roofing Kettle. The kerosene fuel spewed onto the employee and ignited from the burner flame, causing fatal burn related injuries. Among other methods,one feasible and acceptable abatement method to correct the hazard is to follow the Garlock Roofing Operator's Instruction manual and allow the kettle to cool down before any attempts are made to drain tank and clean the fuel lines to the burners of the kettle.
