Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to cuts/lacerations or amputations from wood being cut by a circular saw on unstable support. a)At the construction site, 140 West Street, New York, NY On or about November 28, 2001 An employee was injured when cutting a piece of plywood with a circular saw. The plywood was supported on a rolling cart as it was being cut. Among other methods, one feasible and acceptable method to correct this hazard is to comply with the manufacturer's operator's manual. "Use clamps or other practical ways to secure and the support the workpiece to a stable platform." NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
