Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Shop area - the DoAll metal cutting band saw was not equipped with a magnetic restarter or similar device, as prescribed by the American National Standard for Metal Cutting Saws, ANSI B11.10-1990, Section 5.2.3.4, that in the event of an interruption in the electrical supply, would prevent the saw from restarting automatically when power is restored; and, the saw was equipped with an unprotected, toggle-type, motor starter switch instead of a starter switch that was located, designed, constructed, interlocked, or guarded to protect against unintended operation as prescribed by the American National Standard for Metal Cutting band saws, ANSI B11.10-1990, Section 5.2.3.1. Abatement certification only is required for this item in accordance with the requirements of 29 CFR 1903.19(c).s
