Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Shop area - the Craftsman band saw used for cutting brake pads and other materials was not equipped with a magnetic restarter or similar device, as prescribed by the American National Standard for Metal Cutting Saws, ANSI B11.10-1990, Section 5.2.3.4, that in the event of an interruption in the electrical supply, would prevent the saw from restarting automatically when power is restored. Abatement certification only is required for this item in accordance with the requirements of 29 CFR 1903.19(c).s
