Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of electrical burns
and or electrocution
while using metal ladders in close proximity to energized overhead
electrical powerlines:
a)Orange Company Grove - Bermont Properties LLC. - Section 30 Block 33
Employee was carrying a metal ladder in an upright position within 10' of
overhead powerlines, on or about 12/05/01.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT HIS HAZARD OF ABATEMENT
WOULD BE TO:
1. Use non-conductive ladders when working in the vicinity of overhead
electrical
powerlines.
2. Ensure that employees are trained in the recognition and avoidance of
unsafe
conditions associated with work around overhead electrical powerlines.
