Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
a)Worksite; 320 Central Park West, New York, NY:
Employees were exposed to falling 15 feet to the sidewalk and to injury
from the
moving parts of the lift mechanism of the forklift. Two employees were
standing on a
wood pallet raised by a fork lift while they were removing/installing 4 ft
stone facade
sections on the building. Fall protection was not provided. ; Observed on
or about
12/12/01.
Among other methods, one feasible and acceptable method to correct this
hazard is to
provide a standard personnel lift equipped with the required safety
features
(safety work
platform and independent controls) as described in 29 CFR 1926.602(c). Or
provide other
safe means of access such as scaffolding.
NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED
IN THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT SUBMIT
CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS
NORMALLY REQUIRED BY 29 CFR 1903.19.
