Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and crushing hazards: At the jobsite; an employee was lowered into the excavation and raised from it by riding in the backhoe bucket. While riding in the bucket, the employee was subject to fall out and be crushed between the moving bucket and the walls of the excavation. One feasible and acceptable method to abate this hazard would be to require the employee to use an alternate means of access and egress such as a ladder.
