Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At property site, The seat belt on the 580D Case backhoe was missing, exposing employee to the hazard of being struck by the backhoe in the event of an accident. Among other methods, one feasible and acceptable method to correct this hazard is to install seat belts on the backhoe that meet the seat belt requirements of Society of Automotive Engineers, SAE-J237, Loader & Dozer 1971.
