Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the construction site located at 108 E. Highland in Jonesboro and on the east side of the new building, an employee operating the Case Corporation Trac Hoe, Model Number 9020B, Product Identification Number DA0202381 was exposed to the hazard of crushing injuries due to the lack of use of the provided seat belt while using the Trac Hoe for dirt work.
