Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Impalement from unprotected form stakes used to stabilize forms at the main entrance and around the perimeter of the building under construction. a) Route 202 - Montville Public Safety Building. Employees passing through or around the north side of the building or through the main entrance could be injured by impalement from unprotected form stakes especially given the trip and fall hazards around the main entrance. Violation observed on or about 02/15/02.
