Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in-between hazards: (a)Land Ethics Ltd at 1391 Speer Blvd, Denver Co. 80204: On or before 6/11/02, the employer did not ensure that three employees working in the area of the Ford 575E, S/N 0310407, remained outside the swing radius of the bucket. This condition exposed these employees to the hazards of being caught in-between the bucket and the manhole vault. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter"). Among other methods, one feasible and acceptable abatement method can be found in SAE J153, surface Vehicle Recommended Practice, Section 7.10 Operating Precautions, which instructs operators to never allow anyone to be under or within reach while the equipment is operating.
