Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employmnent and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to the hazard of being
entangled in equipment
or machinery:
(a) Home Depot Inc., at 500 S. Santa Fe, Denver, CO 80223: On or before
June
14, 2002, the employer required employees in the Rental Shop to wear
aprons
with
kangaroo pockets and string attachments, thereby exposing 10 or more
employees to
the hazard of being caught in moving/rotating parts and/to the hazard of
having rental
equipment catch in the pockets during unloading, thereby causing serious
back/neck
injuries.
Among other methods, one feasible and acceptable abatement method is to
discontinue
the use of aprons for Rental Store employees or to utilize aprons with no
pockets,
strings, or other materials that could become entangled in equipment or
machinery.

enclosed "Sample Abatement-Certification Letter").
