Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in-between hazards: a)Proto Construction and Paving, Inc. at US 40 and County Road 804, Fraser, Colorado 80442: On or before October 1, 2002, an employee rode the rear bucket of a Cat 345B backhoe from the top of the trench, down approximately four feet, to cut a pipe near the trench wall. This condition exposed this employee to hazards of falls of approximately 11.8 feet, to being struck by the bucket, to being caught in-between moving parts of the bucket, and to being caught in-between cave-ins and the bucket. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter"). Among other methods, one feasible and acceptable abatement method can be found in SAE J153, Surface Vehicle Recommended Practice, Section 4.3 Operator - General Precautions, instructs operators: "Do not permit riders on the machine if there are no manufacturer's designated place for a rider." In addition, Section 7.10, Operating Precautions, instructs operators to never allow anyone to be under or within reach while the equipment is operating.
