Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck or crushed by an elevated load that was improperly attached to the teeth of the excavator bucket.AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: 1) Instruct employees in the proper techniques of lifting objects as required by the Operators/Maintenance Manual for the excavator. 2) Follow the requirement of the CIMA Safety Manual for Hydraulic Excavator states, Items to be lifted by hydraulic excavator are to be slung from the manufactures designated lift point, pg 26.
