Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from overturning forklifts due to the fact that the operator restraint systems (seat belts) provided on the forklift trucks were not required to be used, as required by ASME B56.1-1993:: a.Establishment: Employees operating forklift trucks were not required to wear seat belts when provided. Abatement Note: One feasible and acceptable abatement method to correct this hazard is to require and effectively enforce the use of operator restraint systems (seat belts) while operating forklift trucks provided with them.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of more than 15 feet when working on top of the rail cars. a.Establishment, Yard Area: Employees are required to work on top of rail cars without fall protection when unloading wood pallets. Abatement Note: One feasible and acceptable means of abatement would be to install and require the use of a fall protection system while employees area on top of the rail cars.
