Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed a fall hazard: On or about 09/17/03 a Lull fitted with a personnel platform, in use, did not have an operator at the controls and the employee in the platform was not standing on the platform floor but on a wood plank resting on the guardrail system. Among other feasible and acceptable methods to correct these hazards is to ensure that the operator and employees follow the owner/operator manual and refer to ASME/ANSI B56.6 Safety Standard for Rough Terrain Forklift Trucks, Section 5.15.
