Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to fall and crush hazards when scissor-type personnel lift #3
on the Railway Dry
Dock toppled over, due to the failure of a replacement plank on the dock.
The hemlock
replacement plank broke at the point of a large knot. Among other methods,
one feasible and
acceptable abatement method to correct these hazards would be to insure
that the Dock manager
and the competent person determine that the surface and supports can
support all loads forces
imposed by aerial platform in all operating configurations. This would
include training on and
compliance with ANSI/SIA A92.6-1999, entitled Self Propelled Elevating
Work Platforms
particularly those sections pertaining to workplace inspection, slope and
grade, and operator
warning and instructions.
