Section 5(a)(1) of the Occupational Safety and Heath Act of 1970: The employer did not furnish employment and a place of emloyment which were free from recognized hazards that were causing or likely to cause death or serious phyiscal harm to employees in that employees wre exposed to the hazard of "falling from elevation": (a) Black Hawk Freight Services, 14000 E. Moncrief Pl., Aurora, CO 80011: On or before 4/3/03, the employer did not ensure that a scissorlift was equipped with complete standard railing to prevent a fall from elevation when in operation. The midrail on one end of the working platform was missing. The employer had rigged a chain to act as the midrail, however the chain was not long enough to reach across the opening and the hook used to attach the chain was missing. The scissorlift was used within the last 6 months to change light bulbs in the ceiling that could not otherwise be reached by ladder. This condition exposed employees to a fall hazard. Abatement note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").
