Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which was free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees:
The employer did not provide employees the necessary training for the safe
operation of a Case
Front-end Loader, Model 570 LXT while working at the following location:
a.Trovas Homes Project, Intersection of Amador Ln and Cielo
Abierto Wy.  The employer did not ensure that an employee was
prevented from standing on the access step of the loader while the
equipment was traveling in the reverse direction.  The employee
fell and was ran over by the left front tire causing multiple injuries
that resulted in his death.  The operator and the deceased were not
trained to recognize hazards associated with the loader's operation.
REFERENCE:  The Operators Manual, 570 LXT Loader/Loader Landscaper, page
14:  Do not
allow other persons on the machine.  Other persons can fall or can cause
an accident.  This is
a one person machine with one operator's seat and is to be operated by one
person
only.
One feasible and acceptable abatement method is to train employees and
equipment operators
assigned to work on or around front-end loaders to recognize and avoid
hazards associated with
the particular job they were assigned to accomplish.
