Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards. The cage type special purpose elevator (man lift) used at the grain elevator was not equipped with an enclosure at the following locations of at lest seven feet. Employees exposed to fall hazards. a)Distributor level - thirty-two inch (32") square with post/track for man lift on east/west sides. b)Midlevel - gate thirty-four and one-half inch (34 1/2") long, opening between posts forty-two (42") inches wide. Among other methods, one feasible and acceptable abatement method to correct this hazard is: Where the hoistway is adjacent to areas permitting passage of people (e.g., passageways, stairwells, elevator landings), provide an enclosure to a height of not less than 7 feet above the floor or stair treads as required by ASME A17.1-1996, Rule 1500.1. The Midway Coop Assn was previously cited for a violation of this occupational safety and health standard or its equivalent standard Section 5(a)(1) which was contained in OSHA Inspection #303796858, Citation #1, Item #2, issued on 03/19/2001. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
