Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to struck-by and crushed-by injuries from the
special purpose
personnel elevator car:
Employees working on the ground floor level of the grain elevator were
exposed to
struck-by and crushed-by hazards in that the special purpose personnel
elevator car
did not have barricades to prevent entry into the car landing area.
ASME A17.1-1996, American Society of Mechanical Engineers in Safety Code
for Elevators
and Escalators, Rule 1500.6a Hoistway Doors and Gates, requires that the
areas around the
special purpose personnel elevator car be enclosed and place a door that
is as high as the
special purpose elevator car or 7 feet whichever is less.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to enclose the landing area with a 7 foot high door with the controls
for the manlift outside
of the enclosed area.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is complete.

were exposed to fall hazards from the special purpose personnel elevator:
The special purpose personnel elevator car located in the grain elevator
did not have
electrical interlock switches or means of locking the doors shut while the
special purpose
elevator car was in motion as required by the american Society of
Mechanical
Engineers
in Safety Code for Elevators and Escalators, ASME A17.1-1996, Rule 1501.2
Locking
Devices for Hoistway Doors or Gates.
ASME A17.1-1996 requires hoistway doors or gates to be provided with
hoistway-door
interlocks or locking devices and electrical contacts which will prevent
starting the car unless
the door or gate is locked in the closed position.
Among other methods, one feasible and acceptable abatement method to
correct the hazard is:
Install electrical contact switches that prevent the operation of the
elevator car until the
gates are closed.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is complete.
