General-duty citation text
Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or caught between hazards: Employees working on the facility were exposed to struck-by and crushing hazards. The brakes on the dump truck were not functional. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Check vehicles in use at the beginning of each shift to assure that equipment and accessories such as lights, service brakes, parking brakes, windshield wipers, horn and any other safety device are in safe operating condition and free of apparent damage. If any safety defect is noted during the inspection, do not allow the vehicle to be operated until repairs have been made by a competent person in accordance with Automotive Engineers Service Brake System Performance Requirements, SAE J155-1971. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.
