Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from the special purpose personnel elevator: The special purpose personnel elevator located in the main elevator did not have electrical interlock switches or other means of locking the doors shut while the elevator was in motion as required by the American Society of Mechanical Engineers Safety Code for Elevators and Escalators, ASME A17.1-1996, Rule 1501.2. Employees exposed to fall hazards from moving elevator car. Among other methods, one feasible and acceptable abatement method to correct the hazard is: to install electrical interlock switches or other means of locking the doors shut while the elevator was in motion as required by the American Society of Mechanical Engineers Safety Code for Elevators and Escalators, ASME A17.1-1996, Rule 1501.2, Locking Devices for Hoistway Doors or Gates. ASME A17.1-1996 requires hoistway doors or gates to be provided with door interlocks or a locking devices and electric contacts which will prevent the start up of the elevator car, unless the door is locked in the closed position. Install electrical contact switches that prevent the operation of the personnel elevator until the gates are closed. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.

Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: Employees working on the ground floor of the grain elevator were exposed to fall hazards in that the special purpose elevator (manlift) opening was not barricaded to prevent entry into the open floor hole when the elevator platform was not at the following locations: a) Ground Floor of Grain Elevator, b) Bin Deck Level of Grain Elevator, exposing employees to struck by hazards and fall hazard greater than 50 feet to concrete below. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enclose the area around the the special purpose manlift and place a door that is high as the special purpose manlift or 7 feet, whichever is less, as required by the American Society of Mechanical Safety Code for elevators and escalators,ASME A17.1-1996,Rule 1500.6a Hoistway Doors and Gates. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.
