North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Ref: ANSI D6.1-1978 Part VI of the Manual on Uniform Traffic Control Devices a)site - employees were working in the roadway without any traffic control devices provided to direct traffic away from the work area. Among other methods, one feasible and acceptable means of abatement would be to set up directional traffic cones as indicated in diagram TA-13. (See attached diagram TA-13 from the 98 MUTCD.)
