North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish to each of his employees conditions of
employment and a place of
employment free from recognized hazards that were causing or likely to
cause death or serious physical
harm to employees, in that employees were exposed to vehicular traffic:
a)job site, in median along Hwy 55, between Carpenter Fletcher Rd. and
Riddle Rd.
(Durham County) - traffic signs were not posted where employees were
exposed to
vehicular traffic in a work zone while conducting roadside surveying.
One feasible and acceptable abatement method to correct this hazard, among
others, is
to provide and require employees to post traffic signs in work zones
indicating "Survey
Crew Ahead", "Work Zone", "Work Ahead", or other messages; to indicate the
presence of employees work zones to alert oncoming motorists before work is
commenced.
