North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to a crushing hazard.
a)job site -  employer failed to establish, implement, and
maintain a preventative maintenance program for the
McNeilus Front Loaders (Model 4020) to monitor the
condition of hydraulic lines, to include age, damage,
wear, flexibility, outer covering protection/condition
and prevent employee(s) exposure to injuries, illness, or
death as a result of repeated hydraulic hose assembly
failures due to lack of total hose replacement every two
years according to manufacture requirements.
One feasible and acceptable abatement method, among
others, to correct this hazard is to ensure that a more
frequent and thorough inspections, maintenance, and
verifiable quality controls of hydraulic hose assemblies
are implemented according to the manufacture's
specifications in an effort to reduce repeated failures
and initiate a pre-failure replacement program.
