North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards: a)establishment, dipping area - an ARO 1 ton underhung hoist (Model # 7776E-2010-00, Serial # SP537-0901-98) had not had an periodic inspection in the past 12 months. [Reference ANSI B30.16-1981, Section 16-2.1.3: Periodic Inspection, Complete inspections of the hoist shall be performed at intervals as defined in 16-2.1.1(b)(2).]
