North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: warehouse area - where employees use hoists including but not limited to, a Budgit 1 ton hoist attached to a metal structure with a load rating of 1 ton, as an overhead hoist without frequent and regular inspections prior to use to move miscellaneous parts and equipment weighing approximately 300-400lbs for shipment. Abatement note: 1. Implement frequent and regular inspection of the hoist and chain assemblies prior to work being performed.
