North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling loads from hoists which had not been inspected. a)facility, maintenance area - where employees use hoists including but not limited to, a CM 2 ton manual hoist attached to a metal structure with a load rating of 3 tons, without conducting frequent and regular inspections prior to use. The hoists were used as a secondary safety device while repairing equipment weighing 5600-32,000 Abatement note: 1. Implement frequent and regular inspection of the hoist and chain assemblies prior to work being performed. 2. Daily inspections of the appurtenances (hooks and keepers) to ensure that they are working properly.
