North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and a
place of employment free from recognized hazards that were causing or
likely to cause death or
serious physical harm to employees, in that employees were exposed to
being struck-by or being
crushed-by tractor trailer truck being operated in reverse:
a)landfill site - three Waste Industries' tractor trailer drivers were
operating their
trailers in reverse toward the dump face, without an operable external
audible
warning signal device on their vehicles, while other Waste Industries'
truck drivers
and drivers of other companies were in the immediate area [ref. ANSI
Z245.1-1992, Section 7.1.15.2(a)].
One feasible and acceptable method of abatement, among others, to correct
this hazard is
to ensure that all vehicles be equipped with operable back-up alarm
systems which can
sound an alarm that can be clearly heard over the background noise present
in all work
environments in which the vehicles enter.es
