T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to semi trucks pulling away from the loading docks while in the process of being loaded. Employees who are loading trucks are exposed to falls hazards associated with drivers pulling trucks away from the loading docks while they were still in the process of being loaded. Among other methods one feasible abatement method to correct the hazard would be to have employees who are loading the trucks remain in control of the keys to the truck being loaded until loading is complete.
