North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a) facility - the "stacker" conveyor area, the counterweight array, was found to be not-confined in an enclosure, allowing the presence of personnel beneath the counterweight. REFERENCE: ANSI B20, Section5.8 Note: an acceptable mean of abatement would be to fence the area around and under the counterweight array to restrict access.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)facility - the "stacker" conveyor area, it was found that the counterweight arrays hook was not inspected prior to initial used, nor frequently inspected for distortion(such as opening throat). Reference ANSI B30 Section 10-1.4.1(a) and ANSI B30 Section 10-1.4.2(a). Note: an acceptable mean of abatement would be to removed the defective hook, and replace it.
