Section 5(a)(1) of the Occupational Safety and Health Administration Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to the hazard of being impaled on protruding rebar: a)Jobsite: The protruding rebar used for marking out the locations of the piles which were to be driven were not capped or otherwise guarded to protect employees and the subcontractors employees from the hazard of impalement, on or about 8-20-02. NOTE: Among other methods, one feasible and acceptable means of abatement to correct this hazard is to: 1. Cap the protruding rebar with approved rebar caps.
