Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of impalement from unprotected vertically-protruding reinforcing steel bars: a)North east area: The reinforcing steel bar used as a grade stake was not protected, on or about 11/4/2002. NOTE: Among other methods, on feasible and acceptable abatement method to correct this hazard is to : 1.Use an alternative to reinforcing steel bars as grade stakes, such as wooden "surveyor's" stakes. 2.Use accepted rebar impalement protective covers.
