North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to falling logs following equipment failure:
a)manufacturing area, an adequate Frequent Inspection (i.e.
monthly) procedure was not conducted of the Budgit 2-ton
hoist. Reference 16-2.1.2 ANSI B30.16-1981 Overhead
Hoists.
b)manufacturing area, an adequate Periodic Inspection (i.e.
yearly) procedure was not conducted of the Budgit 2-ton
hoist. Reference 16-2.1.3 ANSI B30.16-1981 Overhead
Hoists.
c)manufacturing area, the hook on the Budgit 2 ton hoist
was not equipped with a safety latch. Reference 16-1.2.9
ANSI B30.16-1981 Overhead Hoists.
Note: Among other methods, one feasible and acceptable method
to correct this hazard would be to establish an inspection
process that incorporated these requirements as well as any
other recognized industry standard relating to overhead
