Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about February 28, 2002, employees of MAPTECH, INC., performing pre-design and pre-construction surveying at Wild Goose Bayou, Tichnor, Arkansas, were operating a Fish Master, 12 foot, Jon Boat, Model No. 1232J with a Mercury 15 H.P. motor, S/N OC299193. The Coast Guard rated the boat for use with a 6 H.P. motor. The 15 horse power motor, over-powered the craft, exposing the employees to the hazards of falling into the water and drowning.
