General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being crushed by or caught between the forklift and the ground in the event of an overturn hazard. Two employees were observed operating a Yale-diesel, powered industrial truck in the lumber yard without the use of a seat belt as required by ANSI B56.1-1993. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train employees and enforce the wearing of seat belts while operating forklifts with a Roll Over Protection System (ROPS) or a Fall On Protection System (FOPS).
