General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being caught in or fall from while riding the Thern Material Hoist. Employees using Thern, model 482, PN A7532, for entrance into and exit feed bin #17 were exposed to personal injury hazards from using a material hoist instead of a personnel hoist prior to and on February 21, 2002. Among other methods, one feasible and acceptable method to correct this hazard is using a personnel hoist by manufacturer for lifting employees/material.
